&lt;p&gt;On June 24th 2021, &lt;a href="https://legiscan.com/CO/text/SB094/id/2295917" target="_blank" rel="noopener"&gt;CO SB094&lt;/a&gt; was signed into law which creates a licensing category and requirement for third party logistics providers. &lt;a href="/faq/wholesale-drug-third-party-logistics-providers-3pls"&gt;Third Party Logistics providers&lt;/a&gt; will be required to register with the &lt;a href="https://dpo.colorado.gov/Pharmacy" target="_blank" rel="noopener"&gt;Colorado Board of Pharmacy&lt;/a&gt; as such on an application developed by the Board. This bill is effective as of September 1, 2021.&lt;/p&gt;
&lt;p&gt;The Board is currently working on finalizing the application but does not yet have the date when it will be available and/or enforced. New licenses are expected to begin being issued in early November 2021.&lt;/p&gt;

&lt;p&gt;With the recent passage of &lt;a href="https://www.leg.state.nv.us/Session/81st2021/Bills/SB/SB408_EN.pdf" target="_blank" rel="noopener"&gt;Nevada Senate Bill 408&lt;/a&gt;, it is now required that any pharmacist compounding or dispensing any prescription of a controlled substance or dangerous drug to a patient located in Nevada must be registered with the &lt;a href="https://bop.nv.gov/" target="_blank" rel="noopener"&gt;Nevada State Board of Pharmacy&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;The board is not granting a grace period to licensed nonresident pharmacies, but will be notifying each pharmacy of instructions on how a pharmacist can petition for temporary registration. Per NV BOP, "The temporary registration is valid for 6 months, which should provide adequate time to allow a pharmacist to complete the requirements for full registration."&lt;/p&gt;

&lt;p&gt;Pursuant to &lt;a href="http://gencourt.state.nh.us/bill_status/bill_status.aspx?lsr=2513&amp;amp;sy=2020&amp;amp;sortoption=&amp;amp;txtsessionyear=2020&amp;amp;txtbillnumber=HB1240" target="_blank" rel="nofollow noopener"&gt;HB 1240&lt;/a&gt; all resident and non-resident pharmacy permit numbers ending in an even number (i.e., 0, 2, 4, 6, 8) will now expire on even years and biennially in each odd-numbered year for odd-numbered licenses. If your permit ends in an even number it will now expire 12/31/2020. The &lt;a href="https://www.oplc.nh.gov/pharmacy/" target="_blank" rel="noopener"&gt;New Hampshire Board of Pharmacy&lt;/a&gt; will send out updated permits with the new expiration within the next few weeks via email. With the passage of &lt;a href="https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=201920200SB908" target="_blank" rel="nofollow noopener"&gt;SB 908&lt;/a&gt;, the state of California has passed the Debt Collection Licensing Act, which will, beginning on January 1, 2022, provide for enacting changes for the licensure, regulation, and oversight of debt collectors by the &lt;a href="https://dfpi.ca.gov/" target="_blank" rel="noopener"&gt;Commissioner of Business Oversight&lt;/a&gt;. This law will prohibit a person from engaging in the business of debt collecting in California without a license and also require debt collectors to comply with reporting, examination, and other new legal requirements. The bill also establishes the Debt Collection Advisory Committee within the Department of Business Oversight to advise the commissioner on matters relating to debt collection.&lt;/p&gt;

Nonresident manufacturers will need to apply for the new license type. &lt;p&gt;In an effort to promote the availability of certain medical supplies related to the COVID-19 pandemic as well as to respond to a shortage of fingerprinting services, Governor Newsom of California issued Executive Order N-68-20 which permits entities manufacturing over-the-counter drugs (such as hand sanitizer) to operate in California with only a temporary registration rather than a license from the &lt;a href="https://www.cdph.ca.gov/" target="_blank" rel="nofollow noopener"&gt;Department of Public Health&lt;/a&gt;. Temporary registrations must include self-certification of compliance with the FDA guidance issued for those firms not federally registered as over-the-counter drug manufacturers or medical device manufacturers.&lt;/p&gt;
&lt;p&gt;This temporary registration is permitted until the earliest of any of the following occurs:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The expiration of a six-month registration period after which further temporary registration may be obtained;&lt;/li&gt;
&lt;li&gt;The Department of Public Health suspends or rescinds said temporary registration procedure; or&lt;/li&gt;
&lt;li&gt;The &lt;a href="https://www.fda.gov/home" target="_blank" rel="nofollow noopener"&gt;FDA&lt;/a&gt; withdraws or terminates any applicable federal guidance.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Additionally, the Department of Public Health is to establish procedures which will allow entities affected by the pandemic a grace period of up to 60 days to submit renewal fees after an applicable expiration date. A request for such a deferral must be made on letterhead along with timely application for renewal.&lt;/p&gt;
&lt;p&gt;In response to the lack of fingerprinting services often required for background checks during the licensure process, the Order grants flexibility to the California Department of Criminal Justice in its authority to conduct criminal background checks based on identifying information other than fingerprints.&lt;/p&gt;

&lt;p&gt;In response to the COVID-19 pandemic, the Oregon Construction Contractors Board enacted a &lt;a href="https://www.oregon.gov/ccb/SiteAssets/Pages/Covid-19update/License%20Deferral%20Temporary%20Rule%20Language.pdf" target="_blank" rel="nofollow noopener"&gt;rule change&lt;/a&gt; giving eligible contractors the option to defer their license renewals through June 30, 2020. Licensees are eligible if a license is in active status with an expiration date between March 1, 2020 and June 30, 2020. Licensees that meet this criteria are not required to notify with the Board to receive an extension - the license will automatically remain in active status through June 30, 2020. &lt;p&gt;&lt;strong&gt;Deferral of Business Taxes for Small Businesses&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Quarterly estimated tax payments of the Gross Receipts Tax, Payroll Expense Tax, Commercial Rents Tax, and Homelessness Gross Receipts Tax due on April 30, 2020 will be waived for taxpayers or combined groups that have combined San Francisco gross receipts of $10,000,000 or less in calendar year 2019. These quarterly estimated tax liabilities must be paid along with annual tax payments for the tax year 2020, which will be due by March 1, 2021.&lt;/p&gt;
&lt;p&gt;Please keep in mind these bills are typically mailed in late March, but businesses with gross receipts of $10,000,000 or less in 2019 will receive a letter instead of a bill.&lt;/p&gt;

Their old registration will expire once a new license is issued, and going forward, they will not be required to maintain a non-resident pharmacy registration. &lt;p&gt;Pursuant to Section 503A of the Food, Drug and Cosmetic Act the FDA is directed to develop a Memorandum of Understanding ("MOU") between itself and the states which would institute a system for state boards of pharmacy to track and report the circulation of disproportionate amounts of compounded medications to the FDA.&lt;/p&gt;
&lt;p&gt;The FDA originally released a draft of the MOU in 2015 but this draft received backlash regarding concerns about patient access to certain medications.&lt;/p&gt;
&lt;p&gt;A &lt;a href="https://www.fda.gov/media/91085/download" target="_blank"&gt;revised draft&lt;/a&gt; was released in September of 2018. One notable piece of the revised draft is the loosely defined term "distribution" which could significantly impact the amount of drugs that may be distributed by a compounding facility. Additionally if a state board elects not to sign the MOU, only 5% of total prescription orders dispensed or distributed by a 503A compounder in that state may be shipped out of state.&lt;/p&gt;

&lt;p&gt;The &lt;a href="https://mn.gov/boards/pharmacy/" target="_blank" title="MN BOP"&gt;Minnesota Board of Pharmacy&lt;/a&gt; made changes to their license fees and also created a Third-Party Logistics (3PL) License for businesses shipping or transporting drugs in Minnesota. Both changes went into effect earlier this month.&lt;/p&gt;
&lt;p&gt;Fees for initial and renewal wholesale drug distributor, medical gas distributor and manufacturers licenses have increased to $5,260. Prior to the change, the license fees were just over $200. In addition, opioid drug manufacturer license fees have increased to $55,260. However, the fee will be reduced to $5,260 if the sunset provision is applied.&lt;/p&gt;
&lt;p&gt;The Board also announced the creation of a 3PL license. All 3PLs that ship or transport drugs into or within Minnesota must be licensed by the Board. The Board hopes to have the 3PL license application ready shortly and will require unlicensed 3PLs to become licensed by November 1, 2019. In the meantime, unlicensed 3PLs should apply for a drug wholesaler license and note on the application that they are a 3PL business. Many 3PLs are currently licensed by the Board as drug wholesalers and can continue to operate under their current wholesaler license until a conversion process is in place by the Board. The Board announced that there will be no conversion fee for businesses changing from a wholesale to a 3PL license. &lt;p&gt;Texas electricity brokers are now required to register with the State's Public Utility Commission. &lt;a href="https://capitol.texas.gov/tlodocs/86R/billtext/html/SB01497S.htm" target="_blank" title="Senate Bill 1497"&gt;SB 1497&lt;/a&gt; was recently signed by Governor Greg Abbott and defines brokerage services as "providing advice or procurement services to, or acting on behalf of, a retail electric customer regarding the selection of a retail electric provider, or a product or service offered by a retail electric provider." The bill notes that brokers may not sell or take title to electric energy. There will be no fee to register and the bill will go into effect on September 1, 2019.&lt;/p&gt;
