Colorado to Introduce License Requirement for Third-Party Logistics Providers

On June 24th 2021, CO SB094 was signed into law which creates a licensing category and requirement for third party logistics providers. Third Party Logistics providers will be required to register with the Colorado Board of Pharmacy as such on an application developed by the Board. This bill is effective as of September 1, 2021.

The Board is currently working on finalizing the application but does not yet have the date when it will be available and/or enforced. New licenses are expected to begin being issued in early November 2021.

Nonresident Pharmacists Must Hold Nevada License to Dispense Dangerous Drugs into Nevada

With the recent passage of Nevada Senate Bill 408, it is now required that any pharmacist compounding or dispensing any prescription of a controlled substance or dangerous drug to a patient located in Nevada must be registered with the Nevada State Board of Pharmacy.

The board is not granting a grace period to licensed nonresident pharmacies, but will be notifying each pharmacy of instructions on how a pharmacist can petition for temporary registration. Per NV BOP, "The temporary registration is valid for 6 months, which should provide adequate time to allow a pharmacist to complete the requirements for full registration."

New York Marijuana Business Licensing Regulatory Framework Under Construction

With the passage of New York State Senate Bill S6579A, decriminalizing recreational cannabis use, and the Cannabis/Marijuana Regulation & Taxation Act, Bill S854A, which sets up initial regulations and taxation rules for marijuana products, New York state lawmakers have begun constructing a system by which marijuana businesses can become licensed to operate within the state. Regulators have been quoted estimating a timeline of 10 to 14 months for the final licensing system to be in place, meaning interested businesses may be able to apply and obtain licensure by spring 2022.

Change to New Hampshire Resident and Nonresident Pharmacy Permit Expirations

Change to New Hampshire Resident and Nonresident Pharmacy Permit Expirations

Pursuant to HB 1240 all resident and non-resident pharmacy permit numbers ending in an even number (i.e., 0, 2, 4, 6, 8) will now expire on even years and biennially in each odd-numbered year for odd-numbered licenses. If your permit ends in an even number it will now expire 12/31/2020. The New Hampshire Board of Pharmacy will send out updated permits with the new expiration within the next few weeks via email. Upon receipt of your updated pharmacy permit, the old permit will be deemed invalid.

California's Debt Collection Licensing Act & New License Obligations

California is joining the ranks of states that license debt collection activities. With the passage of SB 908, the state of California has passed the Debt Collection Licensing Act, which will, beginning on January 1, 2022, provide for enacting changes for the licensure, regulation, and oversight of debt collectors by the Commissioner of Business Oversight. This law will prohibit a person from engaging in the business of debt collecting in California without a license and also require debt collectors to comply with reporting, examination, and other new legal requirements. The bill also establishes the Debt Collection Advisory Committee within the Department of Business Oversight to advise the commissioner on matters relating to debt collection.

Vermont Board of Pharmacy Creates a Non-Resident Manufacturer License

The Vermont Office of Professional Regulation and the Board of Pharmacy created a new license type for "Non-Resident Manufacturer". Nonresident manufacturers will need to apply for the new license type. Entities that are both a wholesaler and a non-resident manufacturer, will be required to hold both license types with the appropriate specialties.

The Non-Resident Manufacturer will have three specialties available:

Actual/Contract Manufacturer
Virtual Manufacturer
Re-packager/Re-labeler

The requirement to transition to the correct license type(s) is effective immediately and a new application is required. Please note, if you currently hold a Wholesaler license, the licensing fee to obtain the Nonresident Manufacturer license will be waived.

California Governor Issues Executive Order Regarding Over-The-Counter Drug Regulations

In an effort to promote the availability of certain medical supplies related to the COVID-19 pandemic as well as to respond to a shortage of fingerprinting services, Governor Newsom of California issued Executive Order N-68-20 which permits entities manufacturing over-the-counter drugs (such as hand sanitizer) to operate in California with only a temporary registration rather than a license from the Department of Public Health. Temporary registrations must include self-certification of compliance with the FDA guidance issued for those firms not federally registered as over-the-counter drug manufacturers or medical device manufacturers.

This temporary registration is permitted until the earliest of any of the following occurs:

The expiration of a six-month registration period after which further temporary registration may be obtained;
The Department of Public Health suspends or rescinds said temporary registration procedure; or
The FDA withdraws or terminates any applicable federal guidance.

Additionally, the Department of Public Health is to establish procedures which will allow entities affected by the pandemic a grace period of up to 60 days to submit renewal fees after an applicable expiration date. A request for such a deferral must be made on letterhead along with timely application for renewal.

In response to the lack of fingerprinting services often required for background checks during the licensure process, the Order grants flexibility to the California Department of Criminal Justice in its authority to conduct criminal background checks based on identifying information other than fingerprints.

Oregon Extends Contractor License Renewal Due Date

In response to the COVID-19 pandemic, the Oregon Construction Contractors Board enacted a rule change giving eligible contractors the option to defer their license renewals through June 30, 2020. Licensees are eligible if a license is in active status with an expiration date between March 1, 2020 and June 30, 2020. Licensees that meet this criteria are not required to notify with the Board to receive an extension - the license will automatically remain in active status through June 30, 2020. Those that defer their renewal date will still be required to maintain a bond and insurance with the Board.

Alabama

Tuscaloosa County, AL:

Business license applications are being accepted via regular mail. Applicants must call in advance to confirm the fee to include in the application.

Arizona

Sedona, AZ:

Beginning Wednesday, March 18, 2020, the city of Sedona will close in-person access to city facilities, and move to virtual and phone services.

California

Statewide:

The California Franchise Tax Board (FTB) announced a special tax relief for Partnerships and LLCs. The FTB is moving various business tax filing and payment deadlines that occur on March 15, 2020 through June 15, 2020, to June 15, 2020.

The California Employment Development Department is allowing employers statewide directly affected by the pandemic to request a 60-day extension for state payroll reports without penalty or interest.

Garden Grove, CA:

City Hall is taking appointments for any city services with the exception of water bill payments.

Oakland, CA:

The City has launched a website to serve as a portal for all the local, state and federal resources available to support businesses and workers during this crisis.

San Francisco, CA:

Beginning March 17, 2020 all San Franciscans are advised to stay home with an exception for any essential needs. Please note the following government services are still open:

Police stations
Fire stations
Hospitals
Clinics and healthcare operations
Jails
Courts
Garbage and sanitation
Transportation, including Muni
Utilities (water, power and gas)
City offices

San Diego, CA:

Trucks and other vehicles engaged in delivering grocery items to grocery stores are now exempt from having to comply with any City rules and regulations that limit the hours for such deliveries.

Connecticut

Statewide:

Business tax filing deadlines on or after March 15, 2020 and before June 1, 2020, will have an extended due date of June 15, 2020. Click here for more information regarding this extension.

Georgia

Statewide:

The Georgia Department of Revenue (DOR) is asking taxpayers to conduct all business with DOR through online services.

Atlanta, GA:

The Finance Department is now running a remote schedule indefinitely and is no longer open to the public by phone. The Department is only accepting correspondence by email (biztax@atlantaga.gov).

Indiana

Statewide:

Effective March 18, 2020, the Indiana Department of Revenue customer walk-in centers will temporarily close for in-person services. More information is available here.

Maryland

Statewide:

The Maryland Comptroller has extended filing deadlines for the following: Sales and use tax; withholding tax; admissions & amusement tax; alcohol, tobacco and motor fuel excise taxes; and tire recycling fee & bay restoration fee returns. Businesses with due dates in March, April, and May will now have until June 1st to file. More information is available here.

Michigan

Statewide:

The Michigan Department of Treasury is waiving late penalties for monthly sales, use and withholding tax returns due March 20, 2020. More information is available here.

New York State

Suffolk County, NY:

The Suffolk County Clerk has suspended in-person operations.

North Carolina

Statewide:

The North Carolina Department of Revenue (DOR) has waived penalties and late fees for business tax returns and filings. Per the DOR notice, "the waiver applies to the failure to timely obtain a license, file a return, or pay a tax that is due between March 15, 2020, and March 31, 2020, if the license is obtained, the return or extension application is filed, or the tax is paid by April 15, 2020". Mecklenburg County, NC:

Mecklenburg County has suspended services, closing facilities etc until further notice. The list of affected departments/agencies can be found here.

Ohio

Statewide:

Until further notice, the Ohio Department of Taxation has closed its walk-in center.

Oregon

Statewide:

Corporate Activity Tax returns due April 30, 2020 will not be subject to underpayment penalties. More information is available here.

The Oregon Construction Contractors Board has approved a rule allowing contractors to temporarily defer renewal of their license through June 30, 2020. Contractor are eligible for a renewal deferment if a license is in active status with an expiration date between 3/1/2020 and 6/30/2020. More information can be found here.

Pennsylvania

Statewide:

The Pennsylvania Department of Revenue has closed its district offices to the public. The call center has also closed.

Loyalsock Township, PA:

Until further notice, the Tax Office is closed to the public. Mail and phones will be attended to.

Upper Merion Township, PA:

Until further notice, municipal facilities are closed to the public. Mail and phones will be attended to.

Upper Moreland Township, PA:

Until further notice, municipal facilities are closed to the public. Mail and phones will be attended to.

South Carolina

Statewide:

Tax returns and payments due April 1 to June 1 will now be due June 1, 2020. This includes the following taxes: Sales and use tax, admissions tax, corporate income tax and other business taxes filed to the South Carolina Department of Revenue. More information is available here.

Tennessee

Statewide:

The Tennessee Department of Revenue is not receiving walk-in customers at locations in Jackson, Cookeville, and Shelbyville offices. Walk-in services remains open in Memphis, Nashville, Knoxville, Chattanooga and Johnson City offices.

Virginia

Hamilton, VA:

In accordance with Loudoun County, Virginia's State of Emergency the Town of Hamilton town office is closed to the public but is available via phone and email.

Virginia Beach, VA:

The Virginia Beach business license department staff is remote and can only be contacted by email (business@vbgov.com).

Washington

Statewide:

Businesses that cannot pay their Department of Revenue taxes on time due to the COVID-19 pandemic are being asked to file an extension and a late penalty waiver request. Businesses can also request extensions to file or renew their business licenses by contacting Business Licensing Services via phone (360-705-6741) or email (BLS@dor.wa.gov).

Redmond, WA:

Out of an abundance of caution and in accordance with the King County Public Health guidelines to mitigate the spread of COVID-19, Redmond City Hall will remain closed until Monday, March 23.

San Francisco Eases Tax & Licensing Policies in Response to COVID-19

As the City of San Francisco seeks to mitigate the spread of COVID-19 through a stricter response plan, tax and licensing policies have eased. Please review the updates below, which are effective immediately.

Deferral of Business Taxes for Small Businesses

Quarterly estimated tax payments of the Gross Receipts Tax, Payroll Expense Tax, Commercial Rents Tax, and Homelessness Gross Receipts Tax due on April 30, 2020 will be waived for taxpayers or combined groups that have combined San Francisco gross receipts of $10,000,000 or less in calendar year 2019. These quarterly estimated tax liabilities must be paid along with annual tax payments for the tax year 2020, which will be due by March 1, 2021.

Please keep in mind these bills are typically mailed in late March, but businesses with gross receipts of $10,000,000 or less in 2019 will receive a letter instead of a bill.

Deferral of Business License Fees

The Office of the Treasurer & Tax Collector collects annual license fees on behalf of the Department of Public Health, Fire Department, Police Department, Entertainment Commission, and the Office of Cannabis. License fees due on March 31, 2020 are now extended to June 30, 2020.

Alaska Board of Pharmacy Now Accepting Applications for 3 New License Categories

Alaska Board of Pharmacy Now Accepting Applications for 3 New License Categories

The Alaska Board of Pharmacy is now accepting applications for three newly created license categories: Non-resident wholesale drug distributors, outsourcing facilities, and third-party logistics providers (3PLs). The new licenses are the results of a rule change in Title 12, Chapter 52 of the Alaska Administrative Code. The regulations are available by clicking here.

Prior to the rule change, non-resident wholesale drug distributors, outsourcing facilities and 3PLs were required to hold a non-resident pharmacy registration. Although the Board has not issued an official grace period, businesses are encouraged to submit the application as soon as possible. Their old registration will expire once a new license is issued, and going forward, they will not be required to maintain a non-resident pharmacy registration. Iowa Wholesale Distributors and 3PLs Must Obtain Accreditation by the 2020 Renewal Deadline

Action Required: Iowa Wholesale Distributors and 3PLs Must Obtain Accreditation by the 2020 Renewal Deadline

The December 31, 2019 license renewal deadline is approaching for Iowa Wholesale Distributors and Limited Distributors. This year licensees must obtain accreditation with the National Association of Board of Pharmacy as a Verified Accredited Wholesale Distributor prior to renewing their license. 3PLs also must obtain accreditation prior to their renewal deadline, which is March 31, 2020. Persons or entities that fail to meet this requirements will no longer qualify for the license.

The requirement stems from a 2018 policy change when the Iowa Board of Pharmacy split the Wholesale Drug Distributors License into 3 separate categories: Third-Party Logistics Providers (3PLs), Wholesale Distributors, and Limited Distributors. FDA to Develop Agreement with State Boards to Better Track Compounded Medications Nationwide

Pursuant to Section 503A of the Food, Drug and Cosmetic Act the FDA is directed to develop a Memorandum of Understanding ("MOU") between itself and the states which would institute a system for state boards of pharmacy to track and report the circulation of disproportionate amounts of compounded medications to the FDA.

The FDA originally released a draft of the MOU in 2015 but this draft received backlash regarding concerns about patient access to certain medications.

A revised draft was released in September of 2018. One notable piece of the revised draft is the loosely defined term "distribution" which could significantly impact the amount of drugs that may be distributed by a compounding facility. Additionally if a state board elects not to sign the MOU, only 5% of total prescription orders dispensed or distributed by a 503A compounder in that state may be shipped out of state.

The FDA has indicated it plans to finalize the MOU with the states by the end of 2019.

South Dakota Board of Pharmacy No Longer Accepting Paper Applications

License applications and renewals with the South Dakota Board of Pharmacy will now be handled entirely online. Paper applications will no longer be accepted. The change in policy applies to all businesses with a license issued by the Board and is effective immediately for all upcoming license renewals and new applications.

New License Requirements for Appraisal Management Companies in D.C. and Massachusetts

On July 31, 2019, the governor of Massachusetts signed legislation creating a board of real estate appraisers tasked with regulating appraisal management companies. An appraisal management company (AMC) will be required to register as an AMC in the Commonwealth in order for them to perform appraisal management services or engage in business as an AMC. The Board will collect an application fee, an annual renewal fee, and an initial registration fee among other fees to be determined by the Board at a later date. Similarly, District of Columbia Mayor Muriel Bowser signed legislation on July 31, 2019, creating registration requirements for AMCs. The Department of Insurance, Securities, and Banking will require registration of AMCs engaging in activity in the jurisdiction. Failure to register may result in penalties of up to $5,000. New Jersey Now Accepting Applications for Appraisal Management Company License

The New Jersey State Real Estate Appraiser Board is now accepting applications for Appraisal Management Company Licenses. Per New Jersey Administrative Code, an Appraisal Management Company provides services to creditors or secondary mortgage market participants, and provides such services in connection with valuing a consumer's principle dwelling as security for a consumer credit transaction. In addition to the application form, there are surety bond, license fee, and application fee requirements. The Minnesota Board of Pharmacy Increases License Fee for Certain License Types and Creates a 3PL License

The Minnesota Board of Pharmacy Increases License Fee for Certain License Types and Creates a 3PL License

The Minnesota Board of Pharmacy made changes to their license fees and also created a Third-Party Logistics (3PL) License for businesses shipping or transporting drugs in Minnesota. Both changes went into effect earlier this month.

Fees for initial and renewal wholesale drug distributor, medical gas distributor and manufacturers licenses have increased to $5,260. Prior to the change, the license fees were just over $200. In addition, opioid drug manufacturer license fees have increased to $55,260. However, the fee will be reduced to $5,260 if the sunset provision is applied.

The Board also announced the creation of a 3PL license. All 3PLs that ship or transport drugs into or within Minnesota must be licensed by the Board. The Board hopes to have the 3PL license application ready shortly and will require unlicensed 3PLs to become licensed by November 1, 2019. In the meantime, unlicensed 3PLs should apply for a drug wholesaler license and note on the application that they are a 3PL business. Many 3PLs are currently licensed by the Board as drug wholesalers and can continue to operate under their current wholesaler license until a conversion process is in place by the Board. The Board announced that there will be no conversion fee for businesses changing from a wholesale to a 3PL license. Texas Electricity Brokers Are Now Required to Register with the State PUC

Texas electricity brokers are now required to register with the State's Public Utility Commission. SB 1497 was recently signed by Governor Greg Abbott and defines brokerage services as "providing advice or procurement services to, or acting on behalf of, a retail electric customer regarding the selection of a retail electric provider, or a product or service offered by a retail electric provider." The bill notes that brokers may not sell or take title to electric energy. There will be no fee to register and the bill will go into effect on September 1, 2019.
